Hawaii tax sale surplus funds are held by the county tax collector and if not claimed within 2 years from the deposit, funds may escheat to the state general fund. On the other hand Mortgage foreclosure surpluses are held by the selling authorities for 6 years.

Tax Deed Sales are conducted as a result of tax liens older than three years. Owners have the right to redeem the property within 1 year after the sale is conducted.

Mortgage Foreclosures in Hawaii are commonly  non-judicial way but sometime lenders file lawsuit to obtain a court order to sale. Hawaii statutes do not allow post foreclosure redemption.

For mortgage foreclosures, HRS § 667-27  governs the requirements and procedures. Hawaii statutes do NOT set a specific foreclosure surplus claim deadline. Instead, claims generally fall under HRS § 657-1.

>> We remove those leads that haven't been sold in auction, cancelled, bankruptcy hold, or if the plaintiff buy back the property to cover up the judgment.
